How can I remove my ex boyfriends name off my motorcycle registration. The loan is under my name Read on?
I took out a loan for my ex boyfriend on a harley davidson. He does not appear anywhere on the bank loan, so all payments are under my name only but like an idiot I added him to the registration and insurance. We are no longer together and he wont give me the bike back. So, what are my legal rights if I am the one who got the loan, can I take him off the registration, the insurance? Do I have to report the bike stolen, and if do, do I say he has it? I dont know where he is staying and he lost his job 3 months ago. Please help if you have the answers to any of these questions. Thanks
The registered keeper (on the v5 logbook) is not necassarily the legal owner. It even says so on the v5. If you can prove you own the vehicle, which you clearly can, you can take steps to recover your property.
Its pretty useless using the police, who will regard it as a civil matter and tchnically not stolen. Your insurance will not pay out as you have allowed your boyfriend access to the keys and use of the vehicle.
Did you get finance on the bike? or a personal loan? If you got finance then HPI (experian or equifax) will have this noted and this will hinder him selling it on. If it was a personal loan it would be a good itea to contact equifax and/or experian and register with them your interest in the vehicle. If he sells it you would be stuffed as I quess he would just spend the cash.
you could take him to small claims court (www.moneyclaim.gov.uk) who in my opinion would definately find in your favour and probably award you the full origional cost of the bike, but I doubt you would see the cash, as if he did not have it to buy the bike in the first place then I doubt he does now.
Possibly the best answer is to get the bike reposessed by yourself. This can be done easily and legally, though may involve costs to the repo company on your behalf. A bit long winded to explain here, I suggest you nip down to your local citizens advice office and they will talk you through it (free!).
Lastly, I hope the lesson is learned, dont stick your neck out for losers like this!
