a few law questions?

4. Two adults, John and Jackie, were eating lunch together when John says; “I really need to sell my Harley Davidson motorcycle for $6,000 so I can pay my bills.” Jackie says, “I love mopeds, I will pay you $6,000 for your scooter.” John replies, “Great, I will deliver it on Monday.” Jackie is very upset when she sees the motorcycle on Monday.

a. Was a valid contract formed after Jackie’s response that she would give $6,000 for the scooter i.e. before John’s final response? Why or why not?

b. Was a valid contract formed by the end of the conversation i.e. after John’s final response? If so, is it a unilateral or bilateral contract?

c. Identify and explain any possible ways Jackie could get out of the contract if a valid contract has been formed. In your opinion, would Jackie be successful in rescinding the contract i.e. is it likely a court would declare it void? Why or why not?

d. Is this situation covered by the UCC or common law? Explain.

a. No. Jackie's response was a counter offer, as it offered different terms than what was offered by John.

b. Yes, a bilateral contract for the sale of the scooter was formed. Jackie offered, John accepted.

c. BUT--if there never was a scooter at all and Jackie misunderstood what was offered and John didn't realize that Jackie was not referring to the HD, then they can rescind the contract on the grounds of mistake.

d. Common law. UCC covers goods in commerce, not occasional sales of private parties.

Harley Davidson Insurance -Typical Cost?

I am a 19-year old male who has been riding a motorcycle for about 3 years and took a rider safety course. I was wondering what possible insurance costs would be for a Harley 883 Sportster, probably a 98 or newer (probably nothing newer than a 2005 though). Specifically, I was wondering about American Family Insurance (but any general info would be appreciated too). I am looking to upgrade my bike (along with the size of my engine, ive been driving a 250 for a while now). I beleive american family cant even cover sport bikes for a rider like me, so i was thinking about getting another cruiser/standard style bike. i have kind of been drawn towards Harley, but if insurance is too expensive, ill have to look for something else. Does anyone have any other suggestions for bikes? or general info? thanks
and does anyone know if American Family considers the 500 Ninja a sport bike? I dont know if that bike would be my first choice, but i know there if one for sale around here...

Too many variables such as where you live, what your driving record is like, what type of coverage you're looking for, etc. Phone and surf around for different quotes. That will be the best way to find out which company is cheapest for you.

Far better design than the one HD MoCo just came out with. They used your idea but it is a poor attempt by MoCo!

  • That should be pretty obvious as the court held for Ferguson and against Consumers and awarded damages to Ferguson. (The loss of pre-judgment interest on the award on appeal, over and above the policy limits, is irrelevant to the case as far as how it relates to the relationship between the proprietor and the proprietorship.)

In short, there is no difference between the proprietor and the proprietorship. That's obvious even in the name of the insured as shown on the policy — both the proprietor's name and the name of the business. A sole proprietorship is not a separate legal entity from the individual. Therefore the court correctly ruled that the insurance company was liable under the uninsured/under-insured coverage of the policy.

The outcome MAY have been different had Mr Ferguson formed a corporation AND the policy been issued in the exclusive name of the corporation since a corporation is a separate legal entity.
